1. Acceptance of Terms

By accessing or using CherryFill ('the Service'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

CherryFill is a web-based service that adds countdown timers and basic proctoring features to Tally.so forms. The Service enables users to:

  • Create timed exams using their existing Tally forms
  • Track exam session duration and completion status
  • Monitor basic proctoring data such as tab switches
  • View and export submission data

3. Account Requirements

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account

4. Tally.so Integration

  • CherryFill integrates with Tally.so via their API. You must have a valid Tally.so account to use the Service
  • You are responsible for complying with Tally.so's terms of service
  • CherryFill does not modify your Tally forms; it only embeds them within our exam environment
  • We are not affiliated with or endorsed by Tally.so

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purposes
  • Attempt to circumvent security features or access controls
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to collect personal information without proper consent
  • Resell or redistribute the Service without authorization
  • Use automated systems to access the Service in a manner that exceeds reasonable use

6. Respondent Data

  • You are responsible for obtaining appropriate consent from respondents before collecting their data through CherryFill
  • You must inform respondents about proctoring features (tab tracking) if enabled
  • You are the data controller for any personal data collected from your respondents
  • CherryFill acts as a data processor on your behalf

7. Subscription and Payments

  • Free plans are subject to usage limits as described on our pricing page
  • Paid subscriptions are billed monthly or annually as selected
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • Refunds are provided at our discretion
  • We reserve the right to change pricing with 30 days notice

8. Service Availability

  • We strive for high availability but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with reasonable notice
  • We are not liable for any losses resulting from service interruptions

9. Intellectual Property

  • CherryFill and its original content, features, and functionality are owned by us
  • You retain ownership of your Tally forms and the data you collect
  • You grant us a limited license to process your data as necessary to provide the Service

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided 'as is' without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you in the past 12 months
  • We are not responsible for the accuracy or completeness of data from third-party services (Tally.so)

11. Proctoring Disclaimer

CherryFill provides basic proctoring features (tab switch tracking). These features:

  • Are not a substitute for in-person proctoring
  • Cannot guarantee detection of all forms of cheating
  • May produce false positives (legitimate tab switches may be flagged)
  • Should be used as one factor among many in assessing exam integrity

12. Termination

  • You may terminate your account at any time by deleting it in your settings
  • We may terminate or suspend your account for violations of these terms
  • Upon termination, your data will be deleted according to our data retention policies

13. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of significant changes via email.

14. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the appropriate courts.
